Care home briefing 138 – Assessing the need for a DoLS authorisation

The dust has now settled a bit on the Cheshire West decision. Numerous DoLS authorisations have been sought and many local authority DoLS teams are struggling with the number of these.

CQC have said that they will be reviewing providers’ approach to DoLS as part of their inspection process and registered providers would be well advised to have appropriate documentary evidence in place to demonstrate their compliance with the approach confirmed by the Cheshire West decision.

Registered providers may find it useful to undertake an assessment of each patient using the attached audit form to capture the relevant information and evidence the consideration undertaken.
