Gender pay gap

The Institute of Fiscal Studies (IFS) has published research which highlights that women earn 18% less than men on average.

The publication of this research is timely as yesterday (22 August 2016), the Equality Act 2010 (Commencement No.11) Order 2016 (SI 839/2016) was published, which allows the draft Equality Act 2010 (Gender Pay Gap Information) Regulations 2016 to come into force.

These regulations will give the Government the power to require private and voluntary sector employers – with at least 250 employees – to publish information relating to pay, in order to establish whether there is a difference in pay between their male and female employees.

It is likely that the first “relevant date” under the regulations would remain at 30 April 2017, meaning that the first gender pay gap reports will be due in April 2018.

The publication of the reports will highlight the worst offenders, as employers will be ranked in a league table, which could cause widespread embarrassment and reputational risk.

The first pay gap report is not due until April 2018, which will give employers this period to collate data and deal with any pay differences.

The level of content required for the reports is extensive and requires employers to publish a variety of information in relation to pay and bonuses. It is recommended that employers start preparing for the publication of the reports now, to save any potential non-compliance nearer the deadline.
