What to expect in 2013 ….
In this month’s Employment Law News, we look forward to what to expect in 2013 and highlight two changes that may be of interest.
The Tribunal compensation limits are set to increase as follows:-
Current 1 February 2013
- The maximum
compensatory £72,300 £74,200 award for unfair dismissal
- The maximum limit on a week’s pay £430 £450
- The minimum basic award for certain £5,300 £5,500 unfair dismissals
The Government’s new fee regime will be introduced in the summer of 2013. Claims have been categorised into two types depending on the complexity:-
Level 1 claims which are: unpaid wages, redundancy payments, payments in lieu of notice.
Level 2 claims which are: unfair dismissal, discrimination, equal pay and whistle-blowing.
Claimants will have to pay a fee not only for bringing a claim, but also if the matter proceeds to hearing. The fees are as follows:-
Issue Fee : Level 1 claims – £160
Level 2 claims – £250
Hearing Fee : Level 1 claims – £230
Level 2 claims – £950
This is a welcome change for employers as this may deter spurious claims being brought.
