Once more unto the breach?
Has the value of contractual disciplinary procedures been diminished?
Doctors and Dentists working in the NHS in England and Wales benefit from elaborate disciplinary procedures which are set out in Maintaining High Professional Standards in the Modern NHS [MHPS]. Those procedures contain a number of safeguards for employee’s engaged in the disciplinary process. Whilst employees might naturally assume that any harm they suffer from their employer’s breach of those procedures would entitle them to compensation the recent Supreme Court decision in Edwards v Chesterfield Royal Hospital NHS Foundation Trust suggests otherwise.
